These Terms of Service (“Terms”) govern your use of tokyocarry.com (“the Site”) and any purchases you make from Tokyo Carry. By using the Site or placing an order, you agree to these Terms.

1. About us

Tokyo Carry is operated by Cross Market Holdings LLC, a Washington State, USA limited liability company. Our shipping operations are based in Tokyo, Japan, with our fulfillment partner in Shinagawa-ku. Throughout these Terms, “we,” “us,” and “our” refer to Cross Market Holdings LLC, doing business as Tokyo Carry.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on this Site. By placing an order you represent and warrant that you meet this requirement.

3. Products and pricing

We make every effort to display product information, photos, and prices accurately. However:

  • Colors may appear differently on different displays.
  • We reserve the right to correct typographical errors in product descriptions, prices, or stock availability at any time.
  • If a product is mispriced due to an error and you have placed an order, we will contact you before shipping to confirm the corrected price or cancel and refund.
  • Prices are listed in U.S. dollars unless otherwise indicated.
  • Stock is real-time but not guaranteed; items may sell out between adding to cart and checkout.
  • For U.S. orders, applicable import duties and customs charges are pre-paid by Tokyo Carry through our shipping carrier. The price you see at checkout is the price you pay; you should not receive any additional bill from U.S. Customs or the carrier at delivery. For non-U.S. destinations, prices are exclusive of import duties, taxes, and customs fees, which remain the buyer’s responsibility (see Shipping Policy).

4. Orders and acceptance

Your order is an offer to purchase. We reserve the right to accept or decline any order at our discretion, including for reasons of stock unavailability, payment authorization issues, suspected fraud, restricted destination, restricted-goods compliance, pricing errors, or limitations imposed by our payment processor or shipping carriers. If we decline, we will issue a full refund.

5. Payment

Payments are processed by Stripe, Inc. Tokyo Carry does not store full card numbers. We accept major credit and debit cards and other payment methods displayed at checkout. By providing payment information, you authorize us (through Stripe) to charge your selected payment method for the total order amount including shipping. Available payment methods may vary by country, order value, fraud-screening result, and product category. We may refuse or cancel any order that cannot be processed under our payment processor’s rules.

6. Shipping, customs, and returns

See our Shipping Policy and Returns Policy for full details. In summary:

  • U.S. orders: import duties are pre-paid by Tokyo Carry — no surprise charges at delivery.
  • Other destinations: the buyer is responsible for customs duties, import taxes, and similar fees imposed by the destination country.
  • Most items can be returned within 30 days of delivery in original condition.
  • UK and EU consumers have additional statutory cancellation rights described in the Returns Policy.

7. Intellectual property

The Site, including its design, text, graphics, logos, and original photography, is the property of Cross Market Holdings LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Product names, brand names, and product images may be the property of their respective brand owners and are used for descriptive purposes.

You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written permission, except for personal, non-commercial use such as bookmarking pages or sharing product links.

8. User conduct

You agree not to:

  • Use the Site for any unlawful purpose.
  • Attempt to gain unauthorized access to our systems or other users’ accounts.
  • Place fraudulent or speculative orders.
  • Use automated tools to scrape, copy, or harvest Site content.
  • Interfere with the operation of the Site.

9. Disclaimers

The Site and all products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Product photos and descriptions are provided for reference. Product appearance, packaging, and minor specifications may vary between batches as Japanese manufacturers update their products.

10. Limitation of liability

To the fullest extent permitted by law, Tokyo Carry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use of the Site or any product purchased.

Our total liability for any claim arising from your purchase shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits any liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, gross negligence (where applicable), death or personal injury caused by negligence, or any non-excludable consumer guarantee, statutory warranty, or mandatory consumer right.

11. Statutory consumer rights

Nothing in these Terms or any of our policies excludes, restricts, or modifies any consumer right, statutory warranty, consumer guarantee, or remedy that cannot legally be excluded, restricted, or modified under the laws of your country, state, or province of residence. UK and EU consumers in particular retain all rights granted by mandatory consumer-protection law, regardless of any other provision in these Terms.

12. Indemnification

You agree to indemnify and hold harmless Cross Market Holdings LLC, its operators, and its affiliates from any claim arising from your violation of these Terms, your use of the Site, or your import of products into your country in violation of local law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in King County, Washington, USA, and you consent to the personal jurisdiction of such courts.

If you are a consumer outside the United States, this governing-law and forum clause does not deprive you of any mandatory rights or protections you have under the laws of your country of residence. Nothing in this section limits those rights.

Notwithstanding the above, we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property.

14. Changes to these Terms

We may update these Terms at any time. Updates take effect when posted to this page, with the “Last updated” date revised. Your continued use of the Site after an update constitutes acceptance of the updated Terms.
